Is it really possible to buy a property in Spain without ever leaving your home?

2021 – the year where everything has turned upside down. The world as we used to know it has changed massively and we have all had to make sacrifices as well as to adapt to a different lifestyle. Fortunately, the real estate market adapts to times like this and it´s now possible to buy a house in Spain without ever having to leave the comfort of your home or even your country. The process of buying a property remotely is almost the same as being physically in Spain. The key difference is in the way you can view properties and complete the process.

By paying a deposit

To secure your new home and remove the property from the market, you will need to pay a deposit – easily done remotely via either credit card or bank transfer and leads to a “reservation contract“ (which is completed either by us or your nominated conveyancer).

The deposit and contract are then kept safe and sound until the solicitor has checked that all is in order to progress.

By appointing a power of attorney (POA)

Like any country or property purchase, there are administrative procedures to follow – Spanish bureaucracy is no more complicated than the processes that you are used to, just different, and in another language.

You will need a Power of Attorney (POA).

A POA sometimes takes mythical proportions in terms of your security but in reality, upon your instruction, it simply enables a solicitor to take steps in the process which saves you time and money.

For example, to do anything official in Spain, you will need a NIE (Numero de Identification de Extranjeros), or in other words, a foreigners number. This is completed at the Comiseria and takes only minutes but if you haven’t got the right information, you might need to make another appointment, book another flight to come back, and have yet another delay. A POA is a useful tool and if you´re buying remotely, it’s vital to enable the process.

A POA is also a mandate in writing which is signed off officially by a public notary. It is executed as a deed by the donor (the person authorizing the power of attorney) in favor of a third party (attorney). A Spanish power of attorney normally enables the donor broad powers to deal with each specific transaction. As an example, a power of attorney for the purchase of a property will often include clauses allowing the attorney to open, close, and operate bank accounts, set up direct debits, make payments for the account, arrange utility contracts and payments, pay taxes, submit forms and send and receive notifications to and from different authorities.

To sum up, you hand over the power to your selected solicitor to buy a house for you. Unless you choose differently, the solicitor will use the power of attorney only for transactions related to your purchase. There is nothing to worry about because everything is done only with your stringent agreement. At all times you can revoke the power of attorney.  The power of attorney can be done in your own country. All you would have to do is to visit a notary closest to your home and sign the deed. Your selected solicitor will be in touch with your notary in your home country and make sure that all the paperwork is in order.

And that's it!

The solicitor will prepare the notary appointment, check the land registry, communicate with the seller/seller’s lawyer, transfer all the utility contracts, make sure the property is registered at the land registry and run the conveyancing

The only thing you have left to do is to transfer enough funds to your Spanish bank account (which is opened by your solicitor) to complete the purchase of your future house.

Your representative will go to the notary on the day of signing and sign the deeds for you and take the house keys.

And that’s it. Congratulations, you are now the owner of a property in Spain. Whenever you are ready to come, pop down to the office, collect the keys, and enjoy your own little piece of paradise.
